Abstract

El objeto de la presente aportación es el análisis de la naturaleza del arrendamiento de la vivienda familiar como bien privativo o consorcial. La doctrina ha considerado, mayoritariamente, que el derecho de arrendamiento urbano destinado a vivienda habitual celebrado constante matrimonio es un bien ganancial. Sin embargo, la jurisprudencia ha negado esta calificación, porque desde la STS de 3 de abril de 2009 los pronunciamientos judiciales le otorgan la categoría de bien de naturaleza privativa. Esta apreciación se fundamenta en la aplicación del principio de relatividad contractual, en que el derecho a la subrogación por causa de muerte forma parte del contenido del contrato de arrendamiento, que es independiente del régimen económico matrimonial, y en que el subrogante es quien determine la legislación de arrendamientos urbanos, entre cuyos sujetos prevé el cónyuge supérstite.

The purpose of this contribution is to determine the nature of family home renting as personal property or community property. The doctrine has considered that this lease held constant marriage is community. However, case law has denied this category since the STS on 3 April 2009 because of the principle of contractual relativity. Succession to a tenancy on death is a part of contractual content. This succession is determined by urban lease law, without depending on matrimonial property regime, including surviving spouse.
