Resumo: Neste trabalho, procede-se a uma análise crítica, sob o ponto de vista jurídico-económico, do regime jurídico do medicamento para uso humano em Portugal e identificam-se focos de distorção e ineficiências que são aptos comprometer, em termos de demora, bem como em termos de preço, o acesso aos medicamentos por parte de quem deles necessita. Nele igualmente se formulam diversas propostas de melhoria do regime vigente, no sentido de reduzir aquela demora e aqueles preços, bem como de aumentar a eficiência do mesmo, nomeadamente através do aumento da concorrência e da redução da intervenção pública. Abstract: In this work, a legal-economic analysis of the legal regime of the medicinal product for human use in Portugal is carried out and there are identified shortcomings and inefficiencies that are apt to compromise, in terms of delay, as well as in terms of price, access to medicines by those who need them. A number of proposals to improve the current system are also formulated to reduce delays and prices and to increase efficiency, in particular by increasing competition and reducing public intervention.
