A presente dissertação pretende abordar a problemática da regulação de criptoativos, mais concretamente, em primeiro plano, através de uma análise dos mecanismos tecnológicos em que assentam todos estes ativos, passando, em segundo plano, para uma contextualização de alguns diplomas legais que foram até ao momento, concebidos para tentar restaurar a segurança jurídica, que se vinha a deteriorar, principalmente nos ramos financeiros, empresariais e fiscais. Para além destes diplomas, irá ser abordada, a possibilidade de adotar normas legais que já se encontram em vigor, para regular ativos financeiros típicos.
This dissertation aims to address the issue of crypto-active regulation, more specifically, firstly, through an analysis of the technological mechanisms on which all these assets are based. Secondly, to a contextualization of some legal diplomas that are designed to try and restore legal certainty, which was deteriorating, mainly in the financial, corporate and tax fields. In addition to these laws, we will explore the possibility of adopting legal norms that are already in place to regulate typical financial assets.
