[ES] El Derecho de excepci?n es aquel sector del ordenamiento jur?dico que pretende resolver situaciones de crisis constitucional, para las que no tiene soluci?n el derecho ordinario, mediante la concentraci?n de poderes en manos de una autoridad y la limitaci?n o suspensi?n de derechos fundamentales. La crisis sanitaria provocada por el COVID-19 ha hecho que se ponga en marcha los estados excepcionales en toda Europa y en nuestro pa?s, en particular. En este trabajo, pretendemos tras analizar el Derecho de excepci?n, hacer un estudio de cu?l ha sido la situaci?n de los derechos fundamentales durante la pandemia. En concreto, analizaremos si proced?a haber declarado un estado de alarma o un estado de excepci?n y, consiguientemente, veremos si los derechos fundamentales se han limitado o suspendido. Haremos un estudio m?s detallado del derecho a la libertad de circulaci?n reconocido en el art?culo 19 Constituci?n Espa?ola debido a la gran controversia jur?dica, pol?tica y social que ha girado en torno a ?l.
[EN] Exceptional law is that sector of the legal system that seeks to resolve situations of constitutional crisis, for which ordinary law has no solution, by concentrating powers in the hands of an authority and limiting or suspending fundamental rights. The health crisis caused by COVID-19 has led to the implementation of exceptional states throughout Europe and in our country, in particular. In this paper, after analyzing the law of exception, we intend to make a study of the situation of fundamental rights during the pandemic. Specifically, we will analyze whether it was appropriate to have declared a state of alarm or a state of emergency and, consequently, we will see whether fundamental rights have been limited or suspended. We will make a more detailed study of the right to freedom of movement recognized in Article 19 of the Spanish Constitution due to the great legal, political and social controversy that has revolved around it.
