Imparcialidad judicial y actividad probatoria en la Corte Penal Internacional

Abstract

La imparcialidad judicial es uno de los pilares fundamentales del proceso penal porque afecta directamente al derecho a un juicio justo y en el ámbito de la justicia penal internacional, el papel que desempeñan los jueces en relación con la actividad probatoria plantea interesantes cuestiones legales. El presente estudio pretende abordar una aproximación a la función judicial de los magistrados en el proceso penal ante la Corte Penal Internacional e identificar las principales dificultades probatorias que se presentan en la práctica, con especial atención a aquellos supuestos en los que los derechos y garantías procesales de las partes están implicados. Judicial impartiality is one of the fundamental pillars of the criminal process because it directly affects the right to a fair trial and in the area of international criminal justice, the role played by judges in relation to evidentiary activity raises interesting legal questions. The present study intends to approach an overview to the judicial function of magistrates in the criminal process before the International Criminal Court and identify the main evidentiary difficulties that arise in practice, with special attention to those cases in which procedural rights and guarantees of the parties are involved. A imparcialidade judicial é um dos pilares fundamentais do processo penal porque afeta diretamente o direito a um juízo justo e, no âmbito da justiça penal internacional, o papel que desempenham os juízes em relação com a atividade probatória apresenta interessantes questões legais. O presente estudo pretende realizar uma análise à função judicial dos magistrados no processo penal diante do Tribunal Penal Internacional e identificar as principais dificuldades probatórias que se expõem na prática, com especial atenção àqueles casos em que os direitos e garantias processuais das partes estão em tensão.
