Abstract

El demandante es un ciudadano danés, nacido en 1919. Trabaja como tallista de piedras preciosas y reside en Narssaq, Groenlandia. Cuando en 1979 el Gobierno Local de Groenlandia decidió introducir impuestos a los nacionales daneses que trabajaban en bases americanas de Groenlandia, muchos de los interesados, entre los cuales no figuraba el Sr. Barfod, llevaron la decisión ante el Tribunal Superior de Groenlandia (Groenlands Landsret). Alegaban que tal decisión era ilegal por los motivos, entre otros, de que ellos no gozaban del derecho de voto en las elecciones locales y no percibían ninguna prestación de las autoridades groenlandesas. Para la resolución del litigio, el Tribunal Superior se componía de un juez profesional y dos asesores no profesionales, ambos funcionarios del Gobierno Local. Unánimemente, falló a favor de éste último en Sentencia de 28 de enero de 1981; esta decisión fue confirmada por el Tribunal Superior de Dinamarca Oriental (Ostre Landsret), el 8 de septiembre de 1983 ("litigio fiscal de 1981 "). Después de haber tenido conocimiento de dicha Sentencia, el demandante escribió un artículo sobre ella, publicado en una revista llamada "Gr0nland Dansk", en agosto de 1982.
