Le jus post bellum : rupture ou continuité ?

Abstract

Le traitement de la question dujus post bellumdans le milieu de la recherche est récent, car cette notion a véritablement émergé après les interventions au Kosovo (1999) et en Irak (2003). C’est la raison pour laquelle la définition de cette notion reste abstraite. Il est nécessaire de faire un travail conceptuel et normatif pour en définir la substance, et cela ne peut être envisagé qu’en se détachant d’un point vue moral et d’une supposée filiation avec les auteurs classiques du droit des gens, pour déboucher sur une analyse positive, politique, juridique et libérale de cette doctrine afin de savoir dans quelle mesure elle trouve son application dans des situations post-conflictuelles particulières ou générales.
