Fortalecer la independencia judicial: reformar para renovar

Abstract

La posición que mantiene la asociación de jueces Foro Judicial Independiente para reforzar la independencia judicial pasa por atacar las dos caras de la misma moneda: despolitizar el sistema actual de elección del Consejo General del Poder Judicial y objetivar los nombramientos discrecionales que corresponden a este. Ambas son exigencias que nos llegan desde Europa para la protección de la separación de poderes y la independencia judicial, además de ser medidas necesarias en la lucha contra la corrupción. Con dos particularidades con relación al primer frente: el sistema de votación de los doce vocales judiciales debe ser uno proporcional y con voto cualificado, a fin de evitar sustituir el control de los partidos políticos por el de las asociaciones judiciales. A su vez, el actual bloqueo en la renovación del Consejo General del Poder Judicial no debe conducirnos a pensar que ello debe resolverse antes que reformar el sistema. Lo correcto desde la perspectiva europea, pero también por un sentido eminentemente práctico, es modificar el sistema de elección antes de proceder a la renovación del Consejo General del Poder Judicial. Lo contrario supondría mantener un sistema que en sí mismo lleva la semilla del bloqueo, amén de permitir que la cobertura de más de cien nombramientos judiciales discrecionales que habrá de afrontar el nuevo Consejo General del Poder Judicial quede en manos de un órgano profundamente politizado.
