El expediente judicial electrónico: su incidencia en el trabajo de los profesionales de la justicia

Abstract

El expediente judicial electrónico es una materia amplia y compleja, a la vez que de gran actualidad, y que preocupa a los profesionales que participamos en el ámbito de la Justicia. Se trata de una parte trascendental del nuevo proceso de modernización de la Administración de Justicia, pero, a la vez, los problemas derivados de su puesta en funcionamiento están generando un nuevo campo de litigiosidad y problemas procesales no conocidos anteriormente que exigen una respuesta judicial. Sin ánimo de exhaustividad, y tras un examen inicial de las principales características del expediente judicial electrónico, se tratarán estos problemas procesales en sede de comunicaciones o documentos para finalmente examinar la Instrucción 1/2018, de 22 de noviembre, del Consejo General del Poder Judicial y las insuficiencias y soluciones que se proponen desde el poder judicial para adaptar el expediente judicial electrónico al trabajo del juez.
