Sistema penitenciario español: virtudes y deficiencias

Abstract

El juez de vigilancia penitenciaria representa la característica más sobresaliente del sistema penitenciario español diseñado e implantado en 1979. Constituye un modelo peculiar que un órgano judicial independiente ejecute las penas así como que vigile el cumplimiento de las mismas y la vida del interno en la prisión. Entre las deficiencias que cabe denunciar, sin duda cabe destacar la influencia negativa que ha provocado la lucha contra el terrorismo y las reformas legales que desde 2003 hasta nuestros días se han llevado a cabo con este objetivo, limitando el margen de arbitrio judicial e incluso la competencia de aquéllos en favor del juez sentenciador. Primero respecto de dichos delitos, después en general. De algún modo se ha desnaturalizado el modelo diseñado en 1979 y, especialmente, la orientación de las penas privativas de libertad que en favor de la rehabilitación y reinserción social proclama el artículo 25.2 de la Constitución Española de 1978.
