Non-Fungible Token (NFT)

Abstract

Non-fungible tokens (NFTs) have gained significant attention in a very short space of time and created new marketing opportunities in the world of sports. Therefore, following the illustration of the technical basics, this publication first examines general legal issues in connection with NFTs, such as their basic legal classification as well as property law. Due to the thematic focus on sports, aspects that arise specifically with regard to the current and potential use of NFTs in this area are examined afterwards. In this context, a special emphasis is placed on copyright law regarding the distribution of NFTs as well as aspects of gambling and personality rights law.The author works as a legal professional at the German Football League (Deutsche Fußball Liga – DFL).
