Abstract

La propuesta de este trabajo se basa en determinar si, tras la sanción de la Ley Nacional de Salud Mental, las medidas de seguridad previstas en el artículo 34 inc. 1 del Código Penal y el sistema dualista del derecho penal argentino mantienen hoy en día plena vigencia. Para ello se partió de la genealogía de las medidas de seguridad como institutos de índole penal y su aplicación y alcances en el derecho positivo nacional. Posteriormente, se analizó la validez de la imposición de las medidas de seguridad por sobreseimiento o absolución conforme el artículo 34 inc. 1 del Código Penal de la Nación tanto ante tratados internacionales de derechos humanos como ante la Ley Nacional de Salud Mental. Así, mediante tal análisis normativo se han encontrado puntos de conexión que permiten considerar no solo la validez de la coexistencia de ambos institutos, sino, fundamentalmente, que la incorporación de la Ley de Salud vino a dotar de mayores derechos y garantías a aquellas personas a las que se les ha impuesto una medida de seguridad por padecimientos mentales.
