Abstract

Lo studio esamina le prassi documentarie dei notai dei tribunali principeschi nei territori dominati dalla dinastia sabauda nel basso medioevo. Si presenta anzitutto la concorrenza tra notai e giudici nella convalida dei contratti: se gli statuti sabaudi due e trecenteschi tendono a subordinare, almeno nei ter- ritori transalpini, l’esecutività degli atti privati alla sigillatura da parte di una curia, l’esame delle soprav- vivenze documentarie rivela un crescente ricorso dei contraenti alla sola convalida notarile. Si analizzano quindi le forme del coinvolgimento dei giudici nel controllo sabaudo sulla trasmissione dei registri di imbreviature dei notai defunti a nuovi professionisti. Si ricostruisce infine la tipologia dei registri giudi- ziari prodotti dai notai sabaudi, distinguendo tra registri d’ufficio e registri di imbreviature e confron- tando le trasformazioni dei due tipi con l’evoluzione delle disposizioni statutarie. Il quadro così tratteg- giato conferma la molteplicità dei livelli, non tutti collegati alla confezione di scritture autentiche, su cui si esprimeva la mediazione tecnica offerta dai notai agli uffici giudiziari sabaudi.

The essay focuses on the documentary manners underpinned by those notaries active in the princely courts in the territories dominated by the House of Savoy in the late Middle Ages. First of all, the competition of notaries and judges is analysed through the topic of deeds’ authentication. Although princely legislation enforced contracts thanks to the practice of affixing judicial seals, however, a thorough analysis of the documents in question reveals an increasing use of notarial authentication employed to the same scope. Secondly, the research investigates the involvement of judges in the control over the imbreviature authored by deceased notaries. Finally, the type of judicial registers is outlined by distinguishing between imbreviature and registers owned by the offices; the transformations of the two types are related to the evolution of the general legislation. The research sheds light on the complexity of the technical mediation – not only as writers of authenticated documents – that notaries offered to judicial offices.
