La prueba en el procedimiento administrativo

Abstract

El Derecho administrativo es una rama del Derecho público, quizá, convocando la historia, una de las de más reciente presencia. Aparece con la Revolución Francesa de 1789, por lo que, puede afirmarse, que es relativamente nueva frente al Derecho civil o penal, pensando que son las más antiguas, y es por ello, quizá, que quienes resuelven divergencias en materia administrativa lo hagan desde una fuente del Derecho civil o penal. El Derecho administrativo, siendo como es, una materia nueva, todos los días va construyendo con firmeza, no sin equívocos y confusiones su propia teoría. Es por ello que en los procedimientos administrativos, incluso en los procesos contenciosos administrativos, la Autoridad a la que le corresponde resolver las controversias entre la Administración Pública y los administrados se confunda, y al momento de decidir, cuando aprecia los hechos, convocando los medios de prueba testimoniales, periciales y documentales, lo haga desde una perspectiva civil o penal, cuando ello es absolutamente errado, en atención a que cada una de las materias tiene intereses jurídicos distintos que resolver. Los hechos entre las ramas del Derecho Privado y Público son diferentes, veámoslo, así, en el proceso civil el requirente de justicia pide reconocimiento y en materia penal se busca lo verdadero o lo falso. En el Derecho Administrativo, la Administración Pública busca alcanzar el cumplimiento del interés público, claro, siempre respetando los derechos de los administrados. Es por lo dicho que al Derecho Administrativo le corresponde, por su naturaleza, entender los hechos e interpretar la prueba de modo distinto, claro, no por ello se puede hablar de poca rigurosidad, pero si, tomar atención a que dicha prueba debe ser valorada desde un escenario distinto, pues no hablamos de derechos privados tutelados, sino del interés público protegido.
