Abstract

El acceso a la información ambiental (IA) es uno de los pilares para promover la participación de la ciudadanía en la realización de los megaproyectos en el país, dado que se proporciona información sobre los impactos que puedan tener y/o vulnerar los derechos humanos de una comunidad. En México, el acceso a la IA se fortalece ante la ratificación del Acuerdo de Escazú, pero, al mismo tiempo, se identifican áreas de oportunidad para garantizar el referido derecho, entre otros derechos humanos correlacionados; ello conlleva a reflexionar sobre algunos retos del acceso a la IA. Este trabajo analiza la regulación del derecho al acceso a la IA en México y sus desafíos, desde una perspectiva jurídica y bioética. Para ello, se empleó la metodología cualitativa y, los métodos deductivo y analítico-sintético para identificar algunas áreas de oportunidad del acceso a la IA en México.

Access to environmental information (EI) is a cornerstone for promoting citizen participation in the construction of megaprojects in the country because it provides information regarding the effects that may arise and/or violate the human rights of a community. In Mexico, access to EI has been strengthened by the ratification of the Escazú Agreement. At the same time areas of opportunity have been identified to guarantee this and other similar human rights, which leads us to examine some of the difficulties to access EI. This work analyzes the regulation of the right of access to EI in Mexico and the challenges it faces from a legal and bioethical perspective. To this end, a qualitative methodology, as well as deductive and analytical-synthetic methods, were used to identify some areas of opportunity to enhance access to EI in Mexico.
