Abstract

Les recherches psychologiques sur la question du témoignage en justice se sont considérablement développées depuis une quarantaine d’années. Les apports de la psychologie sociale et cognitive à l’étude du témoignage oculaire, par la prise en considération du contexte social dans lequel se trouvent les témoins, que ce soit au moment de la commission de l’infraction, lors de leur audition, au cours de l’identification de l’auteur et enfin pendant le procès, permettent de limiter certaines erreurs dans les témoignages et conséquemment dans les décisions judiciaires. Des efforts de formation et de recherche interdisciplinaires devraient être fournis pour sensibiliser les professionnels de la police et de la justice aux biais psycho-sociocognitifs à l’œuvre pendant la procédure judiciaire et les initier aux outils permettant d’y remédier.
