Abstract

Cette contribution analyse les possibilités d’obtenir un statut stable en Suisse pour les femmes migrantes. Elle révèle que les dispositions légales ont des effets discriminatoires envers les femmes non ressortissantes de l’Union Européenne ou de l’AELE. Ces dernières n’ont pratiquement aucune possibilité d’obtenir une autorisation de séjour en vue d’exercer une activité lucrative. Elles peinent aussi à se voir reconnaître la qualité de réfugiée. De fait, un grand nombre de femmes vivent légalement en Suisse dans le cadre du regroupement familial, avec toute la dépendance que cela suppose du point de vue de l’autorisation de séjour, et des conséquences dramatiques en cas de violence conjugale. Beaucoup d’autres sont confinées à la clandestinité, et à la précarité. In this article, the authors analyze the possibilities for migrant women to obtain stable residency status in Switzerland. It argues that the legal provisions have discriminatory effects on women who are not citizens of the EU or EFTA. It is virtually impossible for these women to obtain a permit to work legally in Switzerland. Furthermore, they also have difficulty gaining recognition as refugees. Finally, while a large number of women are able to live legally in Switzerland through family reunion provisions. The dependency this involves can have tragic consequences, especially in cases of domestic violence. Many others are consigned to a clandestine and precarious existence.
