HUKUK TEORİLERİNDE YARGI VE HUKUK UYGULAYICISI FETİŞİZMİ

Abstract

Yargı organı ve hukuku uygulamakla görevli olan organlara hukuk teorisinde özel bir önem atfedilmiştir. Özelde yargı, geneldeyse bütün hukuk uygulayıcıları kuralların asıl muhatabı veya en nihayetinde hukuk sistemini tesis edenorganlar olarak görülmüştür. Hukuk teorilerinin birincil amacı hukuk sistemlerini ve işleyişini açıklamak, hukukun muhataplarının üzerindeki normatifgücünü temellendirebilmektir. Kanımızca özelde yargı organı ve hukuk uygulayıcılarının önemli rolüne ısrarla yapılan atıf, atıfta bulunan hukuk teorilerininhukuk sisteminin işleyişine ilişkin açıklayıcı gücünü zayıflatmaktadır. Fetişistolarak adlandırdığımız bu teoriler, özel kişilerin, yani vatandaşların davranış vetutumlarını önemsizleştirmekte, onları sistemin aslî parçaları olmaktan çıkarıp,sisteme tâbi unsurlar hâline getirmektedir. Kanımızca bu tutum teorik açıdansavunulabilir değildir. Bunu göstermek için makale Hans Kelsen, H.L.A. Hart veAlf Ross’un hukuk teorilerini inceleyecektir. Bu teorilerin yargı organı ve hukukuygulayıcılarına bakışındaki fetişist unsurlar ortaya konacak, sonuç bölümündeyse bu unsurların sakıncaları sunulacaktır.

The judiciary and the law-applying organs have been attributed a specialimportance in legal theory. The judiciary in particular and all law-applyingorgans in general have been viewed as the real addressees of the rules or theorgans ultimately constituting the legal systems. The primary purpose of legaltheories is to explain the legal systems and their functioning and to ground thenormative force of law on its addressees. We believe that this persistentreference to the crucial role of the judiciary and law-applying organs weakensthe explanatory power of these legal theories. These fetishist theories, as wename them, trivialize the actions and attitudes of private persons, i.e. citizens,and renders them components subject to the system rather than being essentialfactors for the system. We believe that this position is theoretically indefensible.In order to demonstrate this, the article will examine legal theories of HansKelsen, H. L. A. Hart and Alf Ross. These theories’ fetishist elements concerningthe judiciary and other law-applying organs will be exposed andinconveniencies of such elements will be presented.
