[ES] El presente trabajo aborda el estudio del derecho de la persona con discapacidad a tomar sus propias decisiones en el ?mbito sanitario. En concreto se estudia el consentimiento informado desde la perspectiva estatal espa?ola y catalana. Las normas sanitarias no se han adaptado a la Convenci?n de Naciones Unidas de los Derechos de las Personas con discapacidad lo que genera contradicciones frente al nuevo paradigma que es preciso subsanar. Se describen los supuestos en los que puede consentir la misma persona con discapacidad y los supuestos en los que consiente una medida de apoyo o un asistente con funciones representativas. Estos supuestos conducen al an?lisis de la voluntad anticipada, de la hipot?tica y del mayor beneficio del paciente. El trabajo finaliza con un estudio jurisprudencial del tema que anuncia fricciones con la nueva normativa. [EN] This paper examines the right of people with disabilities to make their own decisions in the field of healthcare. In particular, the article focuses on the informed consent from the Spanish and Catalan perspective. Health regulations have not been adapted to the United Nations Convent ion on the Rights of Persons with Disabilities, which generates contradictions with the new paradigm that need to be rectified. It lists the cases in which the person with a disability can consent and the cases in which another person with representative functions consents. These cases lead to the analysis of the advance will, substituted judgment, and the patient's best interests. The work concludes with a jurisprudential study that announces frictions with the new regulation.
