Ethics and Administrative Discretion

Abstract

During a time when men are risking their lives to defeat the dictators, some of us should be willing to face certain questions about administrative discretion. Despite the growing importance of administrative discretion, it is a subject which is usually approached negatively, i.e., from the standpoint of the lawyer or judge who is interested in the limits of discretion. Yet, as recently as 1939, Professor Leonard D. White, in his Introduction to the Study of Public Administration, remarked that the study of administrative discretion had never been undertaken from the administrative point of view. Political scientists and lawyers commonly treat administrative discretion as the consequence of indefinite terminology in legislation. From the standpoint of administrators and administrative law there are many other observations to be made concerning discretionary powers and the improvement of their exercise. More and more discretionary powers must be delegated to those who are charged with the regulatory and service functions of government.
