Abstract

O presente trabalho tem por objetivo analisar se lesões difusas ao meio ambiente possuem o condão de acarretar responsabilidade do ofensor por danos morais coletivos. Para tanto, iniciamos o estudo a partir da análise de alguns princípios do direito ambiental e das particularidades do dano ao meio ambiente em relação ao dano tradicionalmente tutelado por nosso ordenamento. Em seguida, abordamos a responsabilidade civil por danos ambientais, demonstrando que as peculiaridades desta espécie de dano acabaram por justificar a adoção, pela legislação pátria, de regras diferenciadas em relação às aplicáveis à responsabilidade civil clássica. Analisamos ainda o instituto jurídico do dano moral e expusemos o entendimento de que ele teria cabimento não somente em caso de dano individual, mas também em lesões coletivas, em especial por ofensa ao direito fundamental ao meio ambiente sadio, em que pese o assunto ainda não se encontre pacificado na jurisprudência.
