Abstract

El 7 de septiembre de 2000, Mexico suscribio, ad referendum, el convenio internacional que contiene el Estatuto de la Corte Penal Internacional (en adelante, CPI). De esta forma nuestro pais se incorporo a la corriente que prohija una justicia penal internacional para la persecucion y sancion de los delitos mas graves, que afectan bienes juridicos cuya preservacion interesa vivamente a la comunidad internacional. A la cabeza de ese catalogo de crimenes gravisimos figura el genocidio; igualmente, los delitos de lesa humanidad y las violaciones al derecho internacional humanitario, como vere en otro lugar de este articulo. Antes de ahora, Mexico habia expresado, en foros internacionales, su deseo de que se arribara a una forma de jurisdiccion penal internacional que superase los problemas que suscitaron —a juicio de nuestro pais y de un sector de la doctrina internacional— otros tribunales de ese alcance. Debia establecerse, asi, un orden sustantivo y adjetivo previo al enjuiciamiento por delitos internacionales, en atencion a los principios nullum crimen nulla poena sine praevia lege y nemo judex sine lege. El organo judicial debia reunir, ademas, ciertas caracteristicas que garantizaran su idoneidad, competencia, independencia e imparcialidad: ser constituido por el acuerdo de los paises integrados en la Organizacion de las Naciones Unidas, no apenas por disposicion del Consejo de Seguridad, y ser profesional y permanente. Los elementos de admisibilidad requeridos por Mexico no figuraban, desde luego, en los tribunales de Nuremberg y Tokio, instituidos por Num. 6, enero-junio 2002
