Abstract

A impossibilidade do legislador em disciplinar todos os fatos sociais tornou imprescindível a atividade criativa do juiz, principalmente quando da interpretação da Constituição. Tal criatividade, porém, não deve aniquilar a atividade legislativa e de governo, devendo ser exercida de forma limitada.
