¿Sesgos de género en el SIDH?

Abstract

El propósito de este artículo es comprender los posibles sesgos de género que pueden orientar el modus operandi del Sistema Interamericano de Derechos Humanos (SIDH) en los casos de tortura y malos tratos en las cárceles. A través de los diferentes sistemas de búsqueda del SIDH se recopilaron 183 decisiones, obtenidas a partir de un conjunto de palabras clave. Su análisis permite observar que las discusiones de género en el SIDH se iniciaron en la década de 1990 y desde entonces prevalecen debates de corte relativamente genérico sobre el tema. El SIDH desarrolla un debate algo más profundo sobre el género en los casos de violencia sexual cometida contra las mujeres presas. Los otros tipos de violaciones parecen ser comunes a hombres y mujeres, caracterizados y clasificados contextualmente. Además, los perpetradores de la violencia no son necesariamente individualizados, ni las medidas impuestas por el Estado tienen generalmente un carácter colectivo. Si bien estos aspectos relativizan ciertas críticas propuestas por la literatura sobre tortura y órganos internacionales de derechos humanos, algunas acciones ejecutadas por el SIDH parecen tener efectos de carácter más transformador en relación con la discriminación de género.
