Una aproximación al reconocimiento de derechos a otros seres vivientes: Caso del Derecho Animal

Abstract

En el último siglo, se ha progresado en el reconocimiento de derechos a los seres humanos. Sin embargo, en las últimas décadas, ha surgido el cuestionamiento sobre si debería extenderse este reconocimiento a seres distintos. A partir de este debate, cabe preguntarse si sería posible reconocer derechos en favor de los animales no humanos, en el Perú. Este artículo se propone esbozar los principales avances en el reconocimiento de derechos en favor de los animales, a partir de un recuento histórico evolutivo del reconocimiento del bienestar animal desde el siglo XVII, cuando el animal era un objeto del entorno humano, hasta las primeras décadas del siglo XXI, donde los intereses animales comienzan a ser legislados. Luego, tras analizar semejanzas y diferencias entre el ser humano y el animal, presenta las posibles categorías atribuibles a este. Por último, identifica la situación actual del animal en las prácticas sociales y cómo su derecho o interés es recogido por el ordenamiento jurídico para fi nalmente proponer alternativas para su incorporación a este.
