
Značilnost "Kelsnovega" evropskega modela ustavnosodne presoje je med drugim centraliziranost takšne presoje v enem samem organu, navadno ustavnem sodišču, ki navadno poleg abstraktne presoje – za razliko od Kelsnovega "prototipa" danes opravlja tudi presojo glede kršitve človekovih pravic. A zaradi vedno večjega kopičenja zadev pred takšnimi sodišči, ki ogrožajo njihovo normalno delovanje, se zdi nujno, da bi se centralizirani model deloma decentraliziral. To bi dosegli npr. tako, da bi tudi nižjim sodiščem še v večji meri zaupali takšno, torej ustavno presojo – toda izključno na področju kršenja ustavnih človekovih pravic in ob doslednem upo{tevanju sodne prakse ustavnega sodišča.
