Abstract

Idarenin gerceklestirmis oldugu faaliyetler nedeniyle kisilerin ugradigi zararlara iliskin tazminat sorumlulugunun sartlari ve bu sorumlulugun hukuki sonuclarinin ortaya konulmasi baglaminda zarar, temel kavrami ve olmazsa olmaz kosulu teskil etmektedir. Bu calismada zarar kavraminin tanimi, unsurlari ve turleri kendine has yapisi ve farklilik tasiyan ozellikleri bakimindan ortaya konularak idarenin mali sorumlulugunun kapsaminin belirlenmesi amaclanmistir. Ayrica gorus ve uygulama farkliliklarinin ortaya cikarilmasinda yeri geldikce konu ile ilgili yargisal kararlardan yararlanilacaktir
