Abstract

Bu calismanin konusunu, 5237 sayili Turk Ceza Kanunu’nda yer alan “Baskasina Ait Kimlik Veya Kimlik Bilgilerinin Kullanilmasi” sucu olusturmaktadir. Kanunda, isledigi suc nedeniyle kendisi hakkinda sorusturma ve kovusturma yapilmasini engellemek amaciyla baskasina ait kimligi veya kimlik bilgilerini kullanan kimse, iftira sucuna iliskin hukumlere gore cezalandirilacagi belirtilmistir. Mulga 765 sayili yasada ayrica ele alinmayan bu suc yeni yasa ile birlikte ‘Adliyeye Karsi Suclar’ bolumunde madde 268’de ayri bir suc olarak duzenlenmistir. Bu itibarla oncelikle guncel Yuksek Mahkeme kararlari isiginda irdelenerek eski yasa ve TCK. Madde 268’in atif yaptigi iftira sucu ile kiyaslamasi asagidaki bolumler altinda yapilmistir
