CONTROLE JURISDICIONAL DE CONVENCIONALIDADE:

Abstract

Este artigo trata sobre o controle de convencionalidade de tratado de Direitos Humanos de caráter supralegal no âmbito do Supremo Tribunal Federal. O problema observado está centrado na possibilidade do STF, em via difusa, realizar a compatibilização de normas infraconstitucionais ou de norma constitucional tendo como parâmetro norma internacional de Direitos Humanos não internalizada pelo rito do parágrafo terceiro do artigo quinto da Constituição Federal. A hipótese é que, em razão do caráter materialmente constitucional dos tratados de Direitos Humanos, e da não exclusão do âmbito dos direitos fundamentais dessas normas, pelo exposto no parágrafo segundo do artigo quinto da Constituição, o STF pode realizar o chamado controle de convencionalidade, utilizando-se dessas normas como paradigma. Por fim, constata-se que os Direitos Humanos são normas de caráter materialmente constitucional e merecem a proteção da Suprema Corte. O método de abordagem utilizado foi o dedutivo e a técnica de pesquisa a bibliográfica.
