The article carries out a comprehensive study of the role and tasks of the National Police of Ukraine in the field of dimensional and weight control (GVK) as a tool of public administration in the field of road transport. It is substantiated that GVK is not limited exclusively to technical procedures for weighing vehicles, but has an administrative and legal nature, being implemented as a component of state policy to ensure road safety, protect road infrastructure and protect the public interest. Based on the analysis of the legislation of Ukraine, subordinate regulatory legal acts, as well as international legal obligations, in particular the provisions of the European Union directives, the powers of the National Police in the field of cargo transportation control are investigated. It is established that the police perform not only law enforcement functions, but also implement administrative-jurisdictional, preventive and executive functions within the administrative regime of the State Traffic Safety Administration. Its organizational and legal status as a subject of state administration authorized to carry out control activities in the public sphere is revealed. Particular attention is paid to the forms and methods of police activity, in particular: control and supervision, preventive, response measures, administrative coercion and the procedure for recording offenses. In the context of the implementation of authority, emphasis is placed on administrative and legal mechanisms for ensuring the rights of participants in the transport process, including compliance with the principles of legality, proportionality, impartiality and procedures for appealing the actions of police officers. The interaction of the National Police with other public administration bodies – Ukrtransbezpeka, Ukravtodor, local governments – is separately analyzed, and problems of duplication of functions, the lack of unified coordination mechanisms and legal certainty of competencies are identified. Based on the results of the study, administrative and legal problems were formulated and promising directions for improving the legal regulation of the National Police’s participation in the field of traffic control were identified. The feasibility of developing a special regulatory act, improving procedures for interagency interaction, digitalization of control processes, as well as strengthening institutional and legal guarantees within the framework of the implementation of state transport policy was substantiated.

У статті здійснено комплексне дослідження ролі та завдань Національної поліції України у сфері здійснення габаритно-вагового контролю (ГВК) як інструменту публічного адміністрування у галузі автомобільного транспорту. Обґрунтовано, що ГВК не обмежується виключно технічними процедурами зважування транспортних засобів, а має адміністративно-правову природу, реалізуючись як складова державної політики із забезпечення безпеки дорожнього руху, охорони дорожньої інфраструктури та захисту публічного інтересу. На основі аналізу законодавства України, підзаконних нормативно-правових актів, а також міжнародно-правових зобов’язань, зокрема положень директив Європейського Союзу, досліджено повноваження Національної поліції у сфері контролю за вантажоперевезеннями. Встановлено, що поліція виконує не лише функції правопорядку, а й реалізує адміністративно-юрисдикційні, профілактичні та виконавчі функції у межах адміністративного режиму ГВК. Розкрито її організаційно-правовий статус як суб’єкта державного управління, уповноваженого здійснювати контрольну діяльність у публічній сфері. Особливу увагу приділено формам і методам діяльності поліції, зокрема: контрольно-наглядовим, превентивним, реагувальним заходам, адміністративному примусу та процедурі фіксації правопорушень. У контексті реалізації владних повноважень акцентовано на адміністративно-правових механізмах забезпечення прав учасників транспортного процесу, включаючи дотримання принципів законності, пропорційності, неупередженості та процедур оскарження дій працівників поліції. Окремо проаналізовано взаємодію Національної поліції з іншими органами публічної адміністрації – Укртрансбезпекою, Укравтодором, органами місцевого самоврядування, та виявлено проблеми дублювання функцій, відсутності єдиних координаційних механізмів і правової визначеності компетенцій. За підсумками дослідження сформульовано адміністративно-правові проблеми та визначено перспективні напрямки вдосконалення правового регулювання участі Національної поліції у сфері ГВК. Обґрунтовано доцільність розроблення спеціального нормативного акту, удосконалення процедур міжвідомчої взаємодії, цифровізації процесів контролю, а також посилення інституційних та правових гарантій у межах реалізації державної транспортної політики.
