PROBLEM DEFINITIONS OF THE SUBJECT IN CORRUPTION CRIMES

Abstract

The article analyzes normative approaches to the concept of the subject of corruption crimes under the new anticorruption legislation. The conclusion is drawn that the expansion of the range of subjects of corruption crimes at this stage is unjustified and requires concretization and a single normative and theoretical consolidation of the notion of “subject of a corruption crime».

В статье проанализированы нормативные подходы к понятию субъекта коррупционного преступления по новому антикоррупционному законодательству. Сделан вывод о том, что расширение круга субъектов коррупционных преступлений на данном этапе является неоправданным и требует конкретизации и единого нормативного и теоретического закрепления понятия «субъект коррупционного преступления».

В статті проаналізовано нормативні підходи до поняття суб’єкту корупційного злочину за новим антикорупційним законодавством. Зроблено висновок про те, що розширення кола суб’єктів корупційних злочинів на даному етапі є невиправданим та вимагає конкретизації та єдиного нормативного та теоретичного закріплення поняття «суб’єкткорупційного злочину».
