The article presents a theoretical and legal analysis of the legal support of the process of digital transformation in Ukraine, which is an integral element of digitalization of all spheres of social life and a requirement of modernity. It was established that the formation of a digital state should be recognized as an activity aimed at systematically improving the legal basis of the organization and functioning of public authorities, with the aim of simplifying the system of public administration and significantly increasing its efficiency. It is emphasized that digitalization is not limited to the exclusive use of technologies; it is characterized by a change in culture integrated into all spheres of human activity. It has been established that legal provision in the context of digital technologies and digital transformation in Ukraine is a state-legal process. The types and range of documents constituting legal support for digital transformation in Ukraine are outlined. Issues of digital technologies that affect not only the law, but are directly reflected in the rule-making and law-enforcement processes are considered. It was determined that modern legal studies of the legal support of the use of digital technologies in the conditions of the transformation of society are usually determined unsystematically and superficially. Urgent issues of legal support of strategic national priority areas of information society development in Ukraine and digital transformation were raised. It was found that the need for effective regulation of legal relations regarding the management and application of digital technologies in the conditions of the transformation of society requires a clear solution to many practical and theoretical problems, as well as appropriate regulatory and legal support.

У статті представлений теоретико-правовий аналіз правового забезпечення процесу цифрової трансформації в Україні, що є невід’ємним елементом диджіталізації всіх сфер суспільного життя та вимогою сучасності. Встановлено, що формування цифрової держави слід визнати діяльністю, що спрямована на системне удосконалення правової основи організації і функціонування органів публічної влади, з метою спрощення системи державного управління та суттєвого підвищення його ефективності. Підкреслено, що цифровізація не обмежується виключним використанням технологій; вона характеризується зміною культури, інтегрованої в усі сфери людської діяльності. Встановлено, що правове забезпечення у контексті цифрових технологій та цифрової трансформації в Україні є державно-правовим процесом. Окреслено види та коло документів, що становлять правове забезпечення цифрової трансформації в Україні. Розглянуто питання цифрових технологій, що впливають не тільки на право, але безпосередньо відображаються на нормотворчих і правозастосовних процесах. Визначено, що сучасні юридичні дослідження правового забезпечення застосування цифрових технологій в умовах трансформації суспільства зазвичай визначаються безсистемно та поверхово. Порушено актуальні питання правового забезпечення стратегічних національних пріоритетних напрямів розвитку інформаційного суспільства в Україні та цифрової трансформації. З’ясовано, що необхідність ефективного регулювання правовідносин щодо управління та застосування цифрових технологій в умовах трансформації суспільства вимагає чіткого вирішення багатьох практичних та теоретичних проблем, а також належного нормативно-правового забезпечення.
