The article is devoted to the disclosure of the organizational and legal principles of the prosecutor’s activity in combating crimes related to arson of military vehicles. In connection with the need to disclose the purpose of this scientific work, it is proposed to consider the specifics of the criminal-legal qualification of such acts, to determine the algorithm of organization of the prosecutor’s procedural management of the pretrial investigation of crimes of this category, and to provide practical advice on countering such a criminal-legal phenomenon. Considerable attention was paid to the analysis and generalization of studied real criminal proceedings about crimes of this category, which made it possible to identify the main problematic issues of prosecutorial and investigative activity in this area, including: the issue of primary qualification, the definition of the pretrial investigation body, the tactics and methods of organizing pretrial procedural management by the prosecutor investigation. On specific examples, attention is focused on the need to carefully study the subjective side of related, in this case, crimes that involve criminal liability for the intentional destruction (damage) of someone else’s property (in the context of this article – a military vehicle), committed by arson, as well as obstructing the legal activities of the Armed Forces of Ukraine. Certain methodical recommendations are given in this regard. In addition to suggestions for improving the prosecutor’s criminal and criminal-procedural activities, an effective algorithm of organizational and coordination measures of the prosecutor’s office to combat crimes related to arson of military vehicles was proposed in this direction. In particular, the creation of interdepartmental working groups with the involvement of representatives of law enforcement agencies (prosecutors’ offices, the National Police, the Security Service of Ukraine, the Military Law and Order Service), as well as state executive and local self-government bodies. The essence, purpose, forms and methods of their activity are disclosed.

Стаття присвячена розкриттю організаційно-правових засад діяльності прокурора із протидії злочинам щодо підпалів транспортних засобів військовослужбовців. У зв’язку з необхідністю розкриття мети даної наукової праці пропонується розглянути особливості кримінально-правової кваліфікації таких діянь, визначити алгоритм організації прокурором процесуального керівництва досудовим розслідуванням злочинів даної категорії і надати практичні поради щодо протидії такому кримінально-правовому явищу. Значної уваги приділено аналізу та узагальненню вивчених реальних кримінальних проваджень про злочини даної категорії, що дало можливість визначити основні проблемні питання прокурорської та слідчої діяльності на цьому напрямку, серед яких: проблематика первинної кваліфікації, визначення органу досудового розслідування, тактика і методика організації прокурором процесуального керівництва досудовим розслідуванням. На конкретних прикладах акцентовано увагу на необхідності ретельного вивчення суб’єктивної сторони споріднених, у даному випадку, злочинів, які передбачають кримінальну відповідальність за умисне знищення (пошкодження) чужого майна (в контексті даної статті – транспортного засобу військового), вчиненого шляхом підпалу, а також, перешкоджання законній діяльності Збройних Сил України. Надано певні методичні рекомендації з цього приводу. Окрім пропозицій удосконалення кримінальної та кримінально-процесуальної діяльності прокурора на цьому напрямку запропоновано дієвий алгоритм організаційно-координаційних заходів органів прокуратури із протидії злочинам щодо підпалень автомобілів військових. Зокрема, створення міжвідомчих робочих груп із залученням представників правоохоронних органів (прокуратури, Національної поліції, Служби безпеки України, Військової служби правопорядку), а також органів державної виконавчої влади і місцевого самоврядування. Викладено суть, мету, форми і методи їх діяльності.
