Criminal characteristics and assessment of violations of state export control rules

Abstract

The article is devoted to the analysis of criminal offenses related to the violation of the procedure for international transfers of goods subject to state export control, in accordance with Article 333 of the Criminal Code of Ukraine. The relevance of the topic in the context of European integration processes, military threats and the need to ensure national security is studied. The dynamics of offenses for 2013-2024 is assessed, in particular the number of registered cases sent to court, convicted persons, types and severity of punishments, as well as the age structure of offenders. The prevalence of fines as the main type of punishment, the low level of application of severe sanctions, such as imprisonment, and the dominance of the age group of 30-50 years among offenders are established. Directions for improving the state export control system are proposed to increase the effectiveness of combating crime and ensure compliance with international standards.

Стаття присвячена аналізу кримінальних правопорушень, пов’язаних із порушенням порядку здійснення міжнародних передач товарів, що підлягають державному експортному контролю, відповідно до статті 333 Кримінального кодексу України. Досліджено актуальність теми в контексті євроінтеграційних процесів, воєнних загроз та необхідності забезпечення національної безпеки. Проведено оцінку динаміки правопорушень за 2013-2024 роки, зокрема кількості облікованих справ, скерованих до суду, засуджених осіб, видів і суворості покарань, а також вікової структури правопорушників. Встановлено переважання штрафів як основного виду покарання, низький рівень застосування суворих санкцій, таких як позбавлення волі, та домінування вікової групи 30-50 років серед правопорушників. Запропоновано напрями вдосконалення системи державного експортного контролю для підвищення ефективності протидії злочинності та забезпечення відповідності міжнародним стандартам.
