In this scientific article, the author examines the necessity for legal guarantees of access to public service to be clearly and precisely defined as an international human rights standard, representing both the minimum and exemplary level of acceptable state conduct towards citizens. However, achieving this goal requires further conceptual development and interpretation of these guarantees. “Legal guarantees of access to the civil service” constitute an integrated system of principles, requirements, procedures, and restrictions enshrined in national and international legislation, designed to ensure the implementation, protection, and safeguarding of citizens’ ability to participate in public administration. It should be clarified that principles are general rules (initial provisions), while requirements and restrictions form the content of substantive rules, and procedures constitute the content of procedural rules. All of the above components of legal guarantees are interrelated and exhibit specific characteristics at both national and international levels.A classification of legal guarantees ensuring the right to access civil service is proposed, categorizing them based on jurisdictional and territorial scope into two categories: universal and regional. It has been determined that the UN Human Rights Committee actively engages in human rights protection on the international stage by considering individual communications regarding violations of the right to access public service and defining the main requirements for its implementation through interpretative decisions. The article examined trends in the interpretation of the right to access civil service in UN Human Rights Committee. Specific examples of the standardization of legal guarantees for access to civil service in regional human rights protection systems and freedoms are analysed. A comparative legal analysis of constitutional legislation in European countries is carried out concerning the establishment of legal guarantees in modern democratic states. The constitutions of foreign countries enshrine the following: equal access for candidates to public service positions; legality, objectivity, and fairness in selection procedures; and neutrality and competence among civil servants. Based on the experience of foreign countries, it has been observed that at the constitutional level, the national legislator typically does not define specific legal guarantees for access to public service during periods of special legal regimes. However, broad guidelines are provided for law enforcers to follow in ensuring this right.

У статті досліджено право на доступ до державної служби як міжнародний стандарт. Запропоновано класифікацію юридичних гарантій забезпечення права на доступ до державної служби за критерієм сфери їх юрисдикційної та територіальної дії з виокремленням таких категорій: універсальні, регіональні, національні (внутрішньодержавні). Встановлено, що активну правозахисну роботу на міжнародній арені здійснює Комітет ООН з прав людини, оскільки розглядає індивідуальні повідомлення щодо порушення права на доступ до державної служби та своїм тлумаченням визначає основні вимоги для його реалізації. Продемонстровано тенденції інтерпретації змісту права на доступ до державної служби в практиці Комітету ООН з прав людини. Проаналізовано конкретні приклади стандартизації юридичних гарантій доступу до державної служби в регіональних системах захисту прав і свобод людини.Проведено порівняльно-правовий аналіз положень конституційного законодавства європейських країн щодо закріплення юридичних гарантій сучасних демократичних держав. Конституції іноземних держав закріплюють: рівність кандидатів на зайняття посад державної служби; законність, об’єктивність та справедливість процедур добору на посади державної служби; нейтральність і компетентність державних службовців. Встановлено, що на конституційному рівні національний законодавець не пропонує спеціальних юридичних гарантій для доступу до державної служби в періоди запровадження особливих правових режимів.
