Legal personality of Artificial Intelligence: the critical view of autonomy

Abstract

The article is devoted to topical issues of the possibility of defining artificial intelligence as a subject of legal relations. The possibility of recognizing artificial intelligence as a subject of legal relations is analyzed, taking into account the criterion of the degree of its autonomy. The possibility of recognizing the legal personality of artificial intelligence is considered from the point of view of The EU Artificial Intelligence Act (2024), taking into account the assessment of tortiousness of artificial intelligence systems and seeing it as a source of increased danger.

Стаття присвячена актуальним питанням можливості визначення штучного інтелекту суб’єктом правовідносин. Аналізується можливість визнання штучного інтелекту суб’єктом правовідносин з урахуванням критерію міри його автономності. Можливість визнання правосуб’єктності штучного інтелекту розглядаються під кутом бачення такої з позицій Європейського Закону про штучний інтелект (2024) з урахуванням оцінки деліктоздатності систем штучного інтелекту та бачення його як джерела підвищеної небезпеки.
