Abstract

Статья посвящена вопросу сравнительного анализа составов преступлений, предусмотренных статьями 1102 и 2585 УК, в частности, установлению общих признаков, которыми признаны: предмет преступления, формы и способы совершения деяния, субъект преступления, а также отличительных признаков, к которым отнесены объект преступления и цель. На основании этого даны рекомендации относительно квалификации деяний по признакам этих преступлений в подобных случаях и их разграничениюОсуществлен анализ норм о стадиях совершения преступления и о добровольном отказе по законодательству постсоветских государств. Установлены системные противоречия этих норм. Предложены пути усовершенствования данных норм.

The article is devoted to the question of the comparative analysis of the corpus delicti under articles 1102 and 2585 of the Criminal Code, in particular, the establishment of common features that recognized: the subject of the crime, the forms and methods of committing the act, the offender, as well as the distinguishing features to which the object of the crime and purpose belong. On the basis of this, recommendations regarding the qualification of acts on these crimes features in such cases and their differentiation are given.

Стаття присвячена питанню порівняльного аналізу складів злочинів, передбачених статтями 1102 та 2585 КК, зокрема, встановленню їх спільних ознак, якими визнані: предмет злочину, форми й способи вчинення діяння, суб’єкт злочину, а також відмінних ознак, до яких віднесено об’єкт злочину та мету. На підставі цього надано рекомендації щодо кваліфікації діянь за ознаками цих злочинів у подібних випадках та їх розмежування.
