Abstract

p. 49-61 El presente ensayo busca introducir al lector en el análisis del llamado fenómeno de los «trasplantes jurídicos» mediante la presentación y comparación de las posturas y visiones que a su respecto han adoptado distintos Iusfilósofos, juristas y políticos a lo largo del tiempo. Este extendido fenómeno de índole jurídica, política y social, ha tenido desde siempre una trascendencia y una influencia mayúscula tanto en nuestra práctica jurídica como en la discusión político-legislativa nacional, mas no ha motivado una atención equivalente en el ámbito doctrinario y académico local. Por ello, este trabajo pretende atraer la atención de los operadores jurídicos sobre el fenómeno de los también llamados «préstamos jurídicos» para, así, intentar generar en torno a esta realidad un debate que redunde en el enriquecimiento de la discusión político-jurídica. This paper aims to introduce the reader to the analysis of the so-called «legal transplantation» phenomenon by exposing and comparing the postures and ideas that different philosophers, jurists and politicians have adopted regarding this matter. This widespread phenomenon -of legal, political and social nature- has always exercised a major influence on both our legal practice and our national political and legislative debate. However, it has not drawn an equivalent attention in the local academic and doctrinal field. Therefore, this work attempts to attract the attention of legal operators to the phenomenon of the also called «legal borrowings» in order to try to generate a debate about it that enriches the political and legal discussion.
