Abstract

La administración del agua, desde el punto de vista de la descentralización, se analiza en este artículo como una opción política. Esta discusión se basa en un análisis del aparato legal e institucional de la política de estado sobre los recursos hídricos en el estado de Bahía, identificando aquellos que podrían significar obstáculos para esa descentralización tenga efecto. Este es un estudio descriptivo exploratorio, un enfoque cualitativo y los datos se obtienen a partir del análisis de las actas de las reuniones de los comités de la cuenca y Entrevista con INEMA de representante. Bahia tiene actualmente 14 comités de cuencas y ninguno de ellos tiene los instrumentos de gestión plenamente en operación. Se concluye que el Estado tiene la intención de seguir siendo el protagonista de la política estatal de recursos hídricos, definiendo la agenda política y regulando el agua de acuerdo con los intereses de los grupos que participan en su control. La descentralización es esencial para que los demás principios y mecanismos dispuestos en la Ley de las Aguas se efectúen.

A governança das águas, sob o ponto de vista da descentralização, é analisada neste artigo como uma opção política. Essa discussão apoia-se na análise dos aparatos legais e institucionais da política estadual de recursos hídricos no Estado da Bahia, identificando aqueles que podem significar barreiras para que a descentralização se efetive. Trata-se de um estudo exploratório-descritivo, de abordagem qualitativa e os dados são provenientes de análise das atas das reuniões dos comitês de bacia e entrevista com representante do INEMA. A Bahia possui atualmente 14 comitês de bacias e nenhum deles tem os instrumentos de gestão totalmente em funcionamento. Conclui-se que o Estado pretende manter-se como o protagonista da política estadual de recursos hídricos, definindo a agenda política e regulando a água de acordo com os interesses dos grupos que participam do seu controle. A descentralização é essencial para que os demais princípios e mecanismos dispostos na Lei das Águas se efetivem.

Water governance, from the point of view of decentralization, is analyzed in this article as a political option. This discussion is based on the analysis of the legal and institutional apparatus of state water resources policy in the state of Bahia, identifying those that may represent barriers for decentralization to take effect. This is an exploratory-descriptive study, with a qualitative approach and data were obtained from the analysis of basin committees’meetings minutes and interview with INEMA representative. Bahia currently has 14 basin committees and none of them has management instruments fully operational. It is concluded that the State intends to maintain its role as the protagonist of the state policy of water resources, defining the political agenda and regulating water according to the interests of the groups that participate in its control. Decentralization is essential so that the other principles and mechanisms set forth in the Waters Law can be effective.
