El Derecho a la Verdad como proceso histórico: La experiencia argentina en la búsqueda de justicia y verdad

Abstract

La estructura del presente artículo se centra en el estudio de la experiencia argentina vinculada al Derecho a la Verdad. Por ello, primero se definirá al Derecho a la Verdad como aquel que permite conocer los hechos y circunstancias en las que se produjo vulneraciones a los derechos humanos, así como conocer a los autores y destino final de las víctimas. Luego, se realiza una exposición del proceso histórico argentino que llevó a consolidar este derecho: las Juntas Militares, la formación de la Comisión Nacional sobre la Desaparición de Personas, las leyes de Punto Final y Obediencia Debida y, finalmente, los Juicios por la Verdad. Argentina aparece como un país emblemático para identificar el proceso de reflexión en torno al Derecho a la Verdad que tiene como consecuencia la consolidación de este derecho.

The structure of this article focuses on the study of the Argentinean experience related to the Right to the Truth. Therefore, first, the Right to the Truth will be defined as a one that allows to know the facts and circumstances of human rights’ violations and to know the authors and fate of the victims. Later, the historic process that allowed to consolidate this right are exposed: the military dictatorship, the formation of the National Commission on the Disappearance of Persons, the laws of Full Stop and Due Obedience and, finally, the Truth Trials. Argentina appears as an emblematic country that allows to identify the debates on Right to the Truth that has resulted in the consolidation of this right.
