ОДНОВРЕМЕННОЕ ПОЛУЧЕНИЕ ВЗЯТКИ ОТ НЕСКОЛЬКИХ ЛИЦ: ПРОБЛЕМЫ КВАЛИФИКАЦИИ

Abstract

На основании проведенного исследования авторы приходят к выводу, что при разграничении единичного получения взятки от нескольких лиц и совокупности преступлений, предусмотренных ст. 290 УК РФ, уголовно-правовая оценка содеянного должна осуществляться с учетом двух критериев: а) характера взаимодействия взяткодателей (совместности или самостоятельности их действий), одновременно передавших взятку одному должностному лицу; б) субъективного восприятия этого взаимодействия со стороны взяткополучателя. С учетом указанных критериев в статье сформулированы частные правила квалификации одновременного получения взятки от нескольких лиц, а также действий посредника во взяточничестве, одновременно оказавшего посреднические услуги двум или более взяткодателям.

Based on the research the authors conclude that the delimitation of unit taking a bribe from several persons and multiple offenses under art. 290 of the Criminal Code of the Russian Federation, criminal and legal assessment of the offense must take into account two criteria: a) the nature of the interaction between givers (together or independently of their actions), simultaneously transmit the bribe to one official; b) subjective perception of this interaction on the part of the bribe-taker. In view of the above criteria the rules of qualification of taking a bribe simultaneously from several persons, as well as actions intermediary in bribery, both provide mediation services to two or more of those who give are formulated in the article.
