Нормативно-правовые основы применения ювенальных технологий в работе с несовершеннолетними правонарушителями

Abstract

Анализируются правовые основы применения ювенальных технологий в работе с несовершеннолетними правонарушителями. Ювенальные технологии позволяют на этапе досудебного и судебного разбирательства привлекать социальных работников и психологов с целью установления истоков противоправного поведения, а также определения адекватных мер уголовно-правового и социально-психологиче ского воздействия на личность правонарушителя. На этапе исполнения судебных решений применение ювенальных технологий позволяет качественным образом организовать процесс ресоциализации. Использование ювенальных технологий в судебной практике предусмотрено в международных нормативных правовых актах, а также в законодательстве Российской Федерации. Опыт развития ювенальных технологий накоплен в Москве и в других регионах Российской Федерации. Развитие ювенальных технологий связано с совершенствованием действующего законодательства.Legal bases of application of juveniletechnologies to working with minor offenders are analyzed. Juvenile technologies allowinvolving social workers and psychologists at pre-judicial and proceeding stageswith the purpose of investigating the sources of illegal behavior, and also definition of adequate measures of legal and socio-psychological influence on the person of the offender. At a stage of executionof judicialdecisionsjuvenile technologies allow to construct the high-quality resocialization process. Use of juvenile technologies in judiciary practice is stipulated in the international normative legal certificates, and also in the legislation of Russian Federation. The court can involve social workers, teachers and psychologists in investigating the criminal case. The service of the assistants to the judge, who also have functions of social workers, is actively applied now. Experience of development of juvenile technologies has been gained in Moscow and in other regions of Russian Federation. Development ofjuvenile technologies is connected with the improvement of the current legislation
