
The draft of the Federal law No. 47538-6 prepared on the basis of the Concept of development of the legislation on the real right, carries out possession classification on types. In this article authors analysed legal essence and bases of differentiation of legality and illegality, integrity and dishonesty of possession, the special attention is paid to that circumstance that the called possessory situations are related only in relation to droitural ways of protection of the rights, but not to means of protection of the actual possession.
Проект Федерального закона № 47538-6, подготовленный на основе Концепции развития законодательства о вещном праве, проводит классификацию владения на виды. В данной статье авторами проанализированы правовая сущность и основы дифференциации законности и незаконности, добросовестности и недобросовестности владения, особое внимание уделено тому обстоятельству, что названные владельческие ситуации имеют отношение только применительно к петиторным способам защиты прав, но не к средствам защиты фактического владения.
