Об объекте правового регулирования уголовноисполнительного права

Abstract

Рассматриваются вопросы определения объекта правового регулирования уголовноисполнительного права. Исследуются, прежде всего, правоотношения, которые возникают в процессе исполнения и отбывания наказаний. В статье предлагается авторская классификация правоотношений данного рода. Вторая задача, разрешаемая автором, связана с пониманием соотношения пенитенциарных и информационных процессов. В статье обосновывается вывод о глубокой взаимосвязи указанных сфер. Следовательно, существует возможность регламентации информационных процессов в пенитенциарной среде нормами уголовно-исполнительного права.

The problems of determining the object of legal regulation of the penitentiary law. Investigated primarily legal relations that arise in the process of execution and serving sentences. The article offers the author's classification of the legal kind. The second task is not prohibited by the author is concerned with understanding the relation of prison and information processes. The article substantiates the conclusion of a deep relationship these areas. Consequently, there is a possibility of regulation of information processes in the prison environment, rules of criminal law enforcement.
