Abstract

The concept of criminal traditions is given in this article. Traditions it is the models and stereotypes of consciousness historically folded, repetitive and saved, relations, conduct and activity of human communities (nations, peoples, classes and groups of people), based on their combined experience, practice and culture, passed to the subsequent generations during great while. Consuetudes are stereotype forms of the social adjusting of activity of people, as the historically folded steady rules (norms) of conduct, folded in the public environment, transmissible from a generation in a generation, entering in habit by virtue of frequent and protracted application (existences). Consuetudes plug in itself the options of traditions. They are social standards conducts which are fastened in public memory and passed from a generation in a generation as forms of conduct are in labor, in the way of life, in intercourse, in education etc. Essence of criminal traditions anti-social, criminal, that distinguishes them from all other traditional options. Specific maintenance of traditions consists of reproducing from a generation in a generation by the representatives of subculture formations of establishments, principles of action and pictures of ideals, fixings the accumulated antisocial experience and speakers by regulation bases of mastering of new terms and tasks of violating law activity. Criminal traditions are passed from a generation in a generation, a criminal environment comes forward their transmitters, and especially expressly it shows up in penitential (correctional) establishments. In attendance and educate centers criminal traditions and set on their basis of prison rules of conduct regulate relations, both among adults and minor condemned.

В статье дается понятие преступных традиций. Традиции это исторически сложившиеся, повторяющиеся и сохраняющиеся модели, и стереотипы сознания, отношений, поведения и деятельности человеческих общностей (наций, этносов, народов, классов и групп людей), основанные на их совокупном опыте, практике и культуре, передаваемые последующим поколениям в течение длительного времени. Обычаи стереотипные формы социальной регуляции деятельности людей, в виде исторически сложившихся устойчивых правил (норм) поведения, складывающихся в определённой общественной среде, передающихся из поколения в поколение, вошедших в привычку в силу многократного и длительного применения (существования). Обычаи включают в себя установки традиций. Они представляют собой социально-стандартизированные образцы поведения, которые закрепляются в общественной памяти и передаются из поколения в поколение как формы поведения в труде, в быту, в общении, в воспитании и т.п. Сущность преступных традиций антиобщественная, преступная, что отличает их от всех иных традиционных установок. Специфическое содержание традиций состоит в воспроизведении из поколения в поколение представителями субкультурных образований установлений, принципов действия и представлений об идеалах, фиксирующих накопленный антисоциальный опыт и выступающих регулятивными основами освоения новых условий и задач противоправной деятельности. Преступные традиции передаются из поколения в поколение, их носителями выступает сама преступная среда, особенно четко это проявляется в пенитенциарных учреждениях. В исправительных и воспитательных учреждениях преступные традиции и устанавливаемые на их основе неформальные нормы поведения регулируют отношения, как среди взрослых, так и несовершеннолетних осужденных.
