Abstract

The article is devoted to the basics of legal regulation of intellectual property in the European Union. The author analyzes the correlation in European intellectual property law of such concepts as "copyright and related rights", "intellectual property", and "industrial property". The article discusses the polysystemic character of the institute for legal protection of intellectual property rights. This feature was formalized in the international legal documents of a universal character. The author studies the main challenges facing the legislation in the field of intellectual property protection in the European Union, and the key documents that constituted the foundations of the EU policy in the field of copyright and related rights.

Статья посвящена основам правового регулирования интеллектуальной собственности в Европейском союзе. Автор анализирует соотношение в европейском праве интеллектуальной собственности таких понятий, как авторское право и смежные права, интеллектуальная собственность и промышленная собственность. В статье рассматривается полисистемность института правовой охраны интеллектуальной собственности, получившая закрепление в международно-правовых документах универсального характера, исследуются основные задачи, стоящие перед законодательством в области охраны интеллектуальной собственности Европейского союза, и основные документы, заложившие основы политики ЕС в области авторских и смежных прав
