Проблемы возмещения ущерба при рождении ребёнка в результате врачебной ошибки: сравнительно-правовой обзор зарубежного законодательства и судебной практики

Abstract

Исследуются проблемы правового регулирования вопросов возмещения ущерба, возникшего в связи с рождением незапланированного ребенка в результате допущенной врачебной ошибки при проведении мер, направленных на предотвращение беременности. На основе анализа зарубежного законодательства и судебной практики делаются выводы о возможности использования иностранного опыта в российской практике.

The topic of this article is the research of a mechanism of the recovery of damages by birth of unwanted and unplanned child, if it was born in consequence of medical mistake. It is main to research the regulation of this question in the foreign law and jurisdiction because the results are proposed for use in Russian law and jurisdiction.
