Влияние глобализации на национальную правовую систему постсоветской России: формы, методы, коллизии

Abstract

Проблематика глобализации и, прежде всего, ее влияния на экономическую, политическую, социальную и непосредственно правовую сферы постсоветской России воспринимается современной наукой и практикой достаточно противоречиво. Применительно к правовой сфере обычно говорят об интернационализации национального права под влиянием международного права, кристаллизации новой, капиталистической, сущности российского права. Вместе с тем вовлеченность в мировое юридическое пространство означает порой откровенное навязывание культурно чуждых идей, моделей. При этом негативные последствия мирового неэквивалентного юридического обмена оказываются нередко гораздо серьезнее, чем достигаемый положительный эффект. Это отчетливо видно на примерах моратория в нашем государстве на смертную казнь или формирования по западным «лекалам» института ювенальной юстиции, которые вызывают взаимоисключающие оценки ученых, политиков, представителей широкой общественности. В связи с этим автор предлагает свое вúдение обозначенных проблем.

The problematic of globalization and, first of all, its influence on economic, political, social and legal spheres of Post-Soviet Russia is perceived by a modern science and practice is inconsistent enough. With reference to legal sphere usually speak about internationalization national law under the influence of international law, crystallization new, capitalist, essence of the Russian law. At the same time the involvement into world legal exchange means at times frank imposing of cultural alien ideas, models. Thus negative consequences world non-equivalent legal exchange appear quite often much more seriously, than a reached positive effect. It is clearly visible on moratorium examples in on the state on the death penalty or formations on western institute «leek-llamas» juvenile justice, which cause mutually excluding estimations of scientists, politicians, representatives of the wide public. In this connection the author offer the vision of the designated problems
