Современные тенденции развития конституционно-правового института предвыборной агитации

Abstract

Статья посвящена исследованию современных тенденций конституционно-правового института предвыборной агитации. Выявлены такие тенденции, как нестабильность законодательства отсутствие устоявшейся модели правового регулирования предвыборной агитации (следствием этой тенденции является большее число спорных ситуаций в тех общественных отношениях, которые в наименьшей степени урегулированы нормами, составляющими институт); постепенное увеличение количества юридических норм конституционно-правового института предвыборной агитации (в качестве негативного результата выявлена опасность смены общедозволительного типа правового регулирования на разрешительный вследствие количественных и качественных преобразований института).

The article covers research modern tendencies of the constitutional law institution development in election campaign. Such tendencies are figured out as instability of legislation absence of established model of legal control in election campaign (as a result of this tendency is disputes in such social relations, which least settled by canons, constituting institute); progressive increase number of laws of constitutional law institution in election campaign (as negative result is risk of change public permissible type of legal control to licensing type as a consequence quantitative and qualitative institute reformation).
