Особенности правовой природы обвинительного заключения, обвинительного акта

Abstract

Поводом для написания статьи стало изучение и анализ 153 Протоколов уведомления об окончании следственных действий, в которых, как выяснено ни как не учитывается указание законодателя. Дается авторская трактовка обвинительного заключения и обвинительного акта как итоговых документов, завершающих предварительное расследование и обосновывающих вывод о возможности направления уголовного дела в суд для рассмотрения его по существу. Особое внимание автор уделил понятию «достаточности собранных доказательств для составления обвинительного заключения».

The main cause to write this paper was the research and analysis of the hundred and fifty-three notification records of the preliminary investigation expiration which, as it was revealed, do not take into account the law marker's instructions. Special attention has been also paid to the concept of the sufficiency of the evidence gathered for the creation of the bill of indictment.
